The Violence Against Women Act (VAWA) provides immigration protections for victims of domestic abuse. VAWA allows certain abused family members of U.S. citizens and lawful permanent residents (LPRs) to “self-petition” for lawful immigration status independently, without the abuser’s involvement. This special immigration provision gives victims a pathway to safely separate from abusive situations and gain legal status on their own.

Congress created the VAWA self-petitioning process in 1994 to combat domestic violence and protect victims. VAWA removed immigration obstacles that kept many victims trapped in abusive relationships. Victims often remain silent about the abuse and endure volatile home environments because they rely on the abuser for legal residency. VAWA finally empowered victims to free themselves from abusive family members who exploit power and control through immigration status.

VAWA has expanded over time to cover additional groups of victims. The victims’ movement worked relentlessly with legislators to enact protections for a broader range of abused relatives. After three reauthorizations, VAWA now allows more victims to self-petition, protects victims from deportation, and increases confidentiality and anti-fraud protections. What if I don't have police reports or medical records of the abuse?

Independent evidence is extremely helpful for VAWA cases, but not required. USCIS allows any credible evidence, and your detailed personal statement is valid proof. We will submit alternate documents such as affidavits from witnesses and experts to corroborate the violence or trauma you suffered.

Many victims are coerced into unlawful acts by abusers or forced into prostitution and trafficking. Criminal bars can often be overcome in VAWA cases with waivers showing the crimes relate to the domestic violence. Our attorneys are experts at addressing criminal issues.
